CliffScout Terms of Service

⚠️ NOT LEGAL ADVICE / LAWYER REVIEW REQUIRED. This document was drafted to reflect how CliffScout works and to provide serious, prominent safety and liability language appropriate for an inherently dangerous activity. It is not legal advice and has not been reviewed by an attorney. Because CliffScout concerns cliff jumping — an activity that can cause serious injury or death — you should have a qualified lawyer in your jurisdiction review and adapt these Terms (especially the assumption-of-risk, waiver, indemnification, limitation-of-liability, governing-law, and dispute-resolution sections) before you rely on them.

These Terms of Service ("Terms") are a binding agreement between you and CliffScout, operated by GatorQuests ("CliffScout", "we", "us"). They govern your use of the CliffScout mobile application and related services (the "Service"). By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.


1. ⚠️ ASSUMPTION OF RISK, SAFETY, AND LIABILITY — READ THIS FIRST

This is the most important part of these Terms. Do not use CliffScout until you have read and understood this section.

1.1 Cliff jumping is inherently and extremely dangerous. Cliff jumping, diving, and related water activities can cause catastrophic injury, paralysis, drowning, and death. Risks include but are not limited to shallow water, submerged or hidden rocks and debris, changing water levels and currents, cold-water shock, misjudged heights, weather, wildlife, and unsafe or illegal access. These risks are inherent to the activity and cannot be eliminated.

1.2 Spot data is community-contributed and unverified. Every spot, height, water depth, hazard, condition, photo, comment, and access note in CliffScout is contributed by users or aggregated from third-party sources. CliffScout does not independently verify, and does not warrant, the accuracy, completeness, safety, legality, or current condition of any spot or any information about it. Information may be wrong, incomplete, outdated, or maliciously false. Water depth and conditions in particular change constantly and can be fatal if relied upon.

1.3 You are solely responsible for your own safety. You — and only you — are responsible for independently inspecting and evaluating any location, the current conditions, the water depth, all hazards, your own physical ability, and whether it is safe and legal to jump, every single time, before you act. Never rely on CliffScout, or on any information in it, as a determination that a spot is safe. The map markers, tier labels (such as "Verified," "Unconfirmed," or "Exploratory"), and any other indicators are community signals only and are not safety guarantees.

1.4 Legal access is your responsibility. Many spots may be on private property, in protected areas, or subject to local laws, ordinances, or seasonal restrictions. CliffScout does not warrant that any spot is legal to access or jump. You are solely responsible for determining and complying with all applicable laws, regulations, property rights, and posted rules.

1.5 Assumption of risk and release. To the fullest extent permitted by law, you knowingly and voluntarily assume all risks associated with cliff jumping and with using information obtained through the Service, and you release, waive, and discharge CliffScout, GatorQuests, and their owners, operators, and contributors from any and all claims, liabilities, demands, or causes of action arising out of or related to your use of the Service or any activity you undertake in connection with it, including claims based on negligence, to the maximum extent permitted by applicable law.

1.6 Not a substitute for judgment or professional advice. CliffScout is an informational and community tool. It is not a safety service, a guide service, or professional advice. If you are not certain a jump is safe, do not jump.


2. Eligibility

The Service concerns an inherently dangerous activity and is intended for adults. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service, or be old enough to form a binding contract and have the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf. You must not be barred from using the Service under applicable law.

3. The Service

CliffScout is a community-driven map and information service for cliff jumping and water spots. It lets you browse spots; view community-contributed details, photos, and links; submit new spots and reports; mark visits; comment; share media links; build a contributor profile; and earn points. Some features require granting location permission. We may change, suspend, or discontinue any part of the Service at any time.

4. Your Account

  • The Service creates an anonymous account for you automatically. You may optionally link it to Sign in with Apple or to an email address to back it up.
  • You are responsible for activity that occurs under your account and for maintaining access to any sign-in method you link.
  • You may delete your account at any time in Settings → Delete my account. See the Privacy Policy for what deletion does.

5. User-Generated Content

5.1 Your content. "User Content" means anything you submit: spots, reports, photos, comments, media links, profile information, and corrections. You retain ownership of your User Content. By submitting it, you grant CliffScout a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute that content within the Service for the purpose of operating and promoting the Service. You grant other users the right to view it through the Service.

5.2 Your responsibility for your content. You represent that you have the rights to submit your User Content, that it does not infringe anyone's rights, and that it complies with these Terms and our Community Guidelines.

5.3 Prohibited content and conduct. You must not submit or do any of the following: - Dangerous misinformation — most seriously, falsely representing that a dangerous spot is safe, or knowingly submitting false heights, depths, hazards, or conditions. This is the most harmful violation on CliffScout and may be acted on immediately. - Harassment, bullying, threats, or targeting of any person. - Hateful, obscene, sexually explicit, violent, or otherwise objectionable content. - Spam, scams, advertising, or repetitive junk; impersonation; or content that infringes intellectual property or privacy rights. - Content that promotes illegal activity, or that encourages unsafe behavior beyond the inherent nature of the activity. - Any attempt to disrupt, abuse, reverse engineer, scrape, or gain unauthorized access to the Service.

5.4 Moderation, reporting, and blocking. CliffScout includes safety tools, and we enforce these Terms: - New spot submissions, reports, and shared media links are reviewed before they appear publicly. Comments appear immediately and are subject to reporting and removal. - Any user can report content they believe violates these Terms or the Community Guidelines (including a dedicated "dangerous misinformation" category). We review reports and act on objectionable content, typically within 24 hours. - Any user can block another user, which hides that user's content from them across the Service. - We may, at our discretion and without prior notice, remove or refuse any content, and we may suspend, ban, or terminate any account that violates these Terms or the Community Guidelines or that we determine poses a risk to the community. - We have no obligation to monitor all content but reserve the right to do so.

6. Intellectual Property

The Service, including its software, design, branding, and aggregated data (excluding User Content and third-party data), is owned by CliffScout / GatorQuests and protected by applicable laws. Map data and tiles are provided by Mapbox and © OpenStreetMap contributors and are subject to their licenses and attribution requirements. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, resell, or exploit the Service or its data except as expressly permitted.

7. Third-Party Services and Content

The Service relies on and links to third-party services and content (for example, Mapbox maps, and external media links such as TikTok, YouTube, Instagram, and Reddit). We do not control and are not responsible for third-party services or content, and your use of them may be subject to their own terms.

8. Disclaimers

THE SERVICE AND ALL CONTENT AND INFORMATION IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Without limiting Section 1, we make no warranty that any spot or any information about any spot is accurate, complete, current, safe, or legal to access, or that the Service will be uninterrupted or error-free.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLIFFSCOUT, GATORQUESTS, AND THEIR OWNERS, OPERATORS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DEATH, PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE OR ANY INFORMATION OBTAINED THROUGH IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us to use the Service in the twelve months before the claim (which, for a free app, is likely zero) or USD $50.

Some jurisdictions do not allow certain limitations or the exclusion of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

10. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless CliffScout, GatorQuests, and their owners, operators, and contributors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 1, 5.1–5.4 license/representations, 6, 8, 9, 10, and 12) will survive.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The courts located in the State of Arizona will have jurisdiction over any dispute not subject to another agreed dispute-resolution mechanism, except where applicable consumer-protection law provides otherwise. (Your lawyer should set the jurisdiction and decide whether to add arbitration and class-action-waiver provisions.)

13. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date above and, where appropriate, provide in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
